Terms & Conditions of the Vitabiotics Online Store

The Vitabiotis online store, operating at https://vitabiotics.pl/, is managed by E-Commerce Solutions Sp. z o.o., with its registered office at ul. Serocka 10, 2nd floor, 04-333 Warsaw (hereinafter referred to as the “Vitabiotics Store” or the “Seller”), NIP 1132871152, REGON 146997715, entered into the Register of Entrepreneurs kept by the District Court for the Capital City of Warsaw, 13th Commercial Division of the National Court Register, under KRS number: 0000487983.

1. General Provisions

These Terms & Conditions define the rules and conditions for the sale of cosmetics in the Vitabiotics online store at https://vitabiotics.pl/ to “Consumers” as defined in Article 22¹ of the Civil Code of April 23, 1964 (consolidated text: Journal of Laws 2014, item 121, as amended).

The sale is carried out via the Internet or by telephone as a distance contract, between the Consumer placing an order (hereinafter referred to as the Buyer) and the Vitabiotics Store (hereinafter referred to as the Seller).

The Seller provides these Terms & Conditions in a PDF format that allows saving them on a durable medium on the Buyer’s device.

The Seller makes every effort to ensure that the rules and conditions of sale through the website vitabiotics.pl shape the rights and obligations of the consumer in accordance with good practices and with respect for their interests.

The Buyer should read these Terms & Conditions. During registration or when placing an order, the Buyer will be asked to accept the provisions of the Terms & Conditions through the provided checkout functionality.

The Buyer may use alternative dispute resolution methods (ADR). In Poland, the most common include arbitration courts and mediation. Additional information on ADR procedures can be found on the website of the Office of Competition and Consumer Protection: http://www.uokik.gov.pl/spory_konsumenckie.php

The Seller’s basic liability is based on statutory warranty as defined in the Civil Code of April 23, 1964 (consolidated text: Journal of Laws 2014, item 121, as amended). Warranty, in turn, is a voluntary declaration regarding the quality of goods made by the entrepreneur. If the Seller introduces products with a warranty, the Buyer will be informed in a clear and understandable manner, in Polish. The warranty will indicate the guarantor’s obligations and the Buyer’s rights in the event that the goods do not conform to the declaration. The warranty does not exclude, limit, or suspend the Buyer’s rights under the statutory warranty for defects.

1. Rules for Purchasing

The Buyer may place orders 24/7 via https://vitabiotics.pl/ or by phone from Monday to Friday between 10:00 and 17:00 at +48 221 230 316.

Placing an order consists of four steps:

1. Selecting the product (“Add to Cart”),
2. Entering the Buyer’s personal data necessary for order fulfillment,
3. Selecting the payment and delivery method,
4. Confirming the order placement by the Buyer.

Upon confirmation of the order, the Seller sends the Buyer, by e-mail to the provided address, a confirmation of receipt of the order along with the order number. The order number allows the Buyer to track the order status.

E-Receipts

An e-receipt is a fiscal document in electronic form, regulated by the VAT Act of March 11, 2004, the Regulation of the Minister of Finance on cash registers, and the Regulation of the Ministry of Entrepreneurship and Technology on the technical criteria and conditions for cash registers.

Issuance of an e-receipt requires the Buyer’s consent. By accepting these Terms & Conditions, the Buyer agrees to receive e-receipts.

The Seller issues e-receipts to the Buyer via the electronic receipt repository eparagony.pl. The receipt is deemed issued upon successful storage in the repository, and the Buyer gains access via a unique link sent to the e-mail address provided with the order.

The Seller may also send a one-time notification to the Buyer’s phone number regarding the issuance of the e-receipt.

If the product is unavailable, the Seller shall promptly, but no later than within 30 days, inform the Buyer and refund the full payment received.

All products offered by the Seller are original.

III. Payment and Delivery Methods

The Buyer may pay for the ordered goods via:
a) bank transfer,
b) Przelewy24,
c) Polskie ePłatności,
d) cash on delivery.

Payments are processed by PayPro SA, ul. Pastelowa 8, 60-198 Poznań, NIP: 779-236-98-87, REGON: 301345068, KRS 0000347935.

The price list and delivery methods are available at the provided link. The Seller does not use hidden or pre-selected payment options.

By placing an order, the Buyer also accepts the courier company’s regulations.

1. Right of Withdrawal

In accordance with Article 27 of the Act of 30 May 2014 on Consumer Rights (Journal of Laws 2017, item 683), the Buyer has the right to withdraw from a distance contract within 14 days without giving a reason, except for the costs described in section IV.4.

The withdrawal period begins when the Buyer or a designated third party (other than the carrier) takes possession of the product.

The Buyer bears the direct cost of returning the product. If the Buyer chose a more expensive delivery method than the cheapest offered, the Seller is not obliged to reimburse the additional costs.

The Buyer is liable for any diminished value of the product resulting from its use beyond what is necessary to determine its nature, characteristics, and functioning.

To withdraw, the Buyer must notify the Seller with an explicit statement (a template withdrawal form is provided but not mandatory).

The Buyer must return the goods without undue delay, no later than 14 days after withdrawal, to:
Vitabiotics, E-Commerce Solutions Sp. z o.o. Centrum Panattoni, ul. Logistyczna 6, 05-250 Ciemne, Dock 31-27 (note: Withdrawal / Return).

Refunds will be issued within 14 days of receiving the Buyer’s withdrawal statement and the goods, using the same payment method as the Buyer used, unless otherwise agreed.

1. Product Complaints

The Seller is obliged to deliver products free of defects. Goods are new, original, and sealed.

In the event of defects, the Buyer may file a complaint under statutory warranty (Articles 556–576 of the Civil Code).

The Buyer may demand:

• replacement of the product,
• repair of the product,
• price reduction,
• contract termination (if the defect is material).

The Seller must handle complaints within 14 calendar days. Failure to respond within this period means the complaint is deemed valid.

The Seller is liable for defects discovered within 2 years of delivery.

VII. Electronic Services via https://vitabiotics.pl/

The website https://vitabiotics.pl/ is managed by E-Commerce Solutions Sp. z o.o., ul. Serocka 10, 2nd floor, 04-333 Warsaw.

The Buyer must respect copyright laws.

Registration on the site is free. Use of its functionalities is voluntary.

The website may use cookies and web beacons for analytical and advertising purposes. Details are available in the Privacy Policy.

Complaints regarding website operation should be sent to: pomoc@vitabiotics.pl or to the company’s address. The Administrator will respond within 14 days.

VIII. Amendments to the Terms & Conditions

Any changes will be published at https://vitabiotics.pl/ at least 14 days in advance, along with a request for acceptance of the amended Terms & Conditions.
